November 2018 - NY PFL Legislative Update: The Living Donor Protection Act

On Monday, November 5, 2018, Governer Andrew Cuomo signed the bill, “The Living Donor Protection Act”. (S.2496-B (Hannon)/A.297-C (Gunther))

Part of this Act expands the definition of "Serious Health Condition" under Paid Family Leave to include transplantation, preparation and recovery from surgery related to organ or tissue donation. This will allow employees to take job-protected, paid time off to care for a covered family member who donates or is preparing to donate, an organ.

This law will go into effect ninety days from the enactment of this bill, or early February, 2019.
